Herexa Health Prescription Policy

This Prescription Policy explains how medications are evaluated and prescribed at Herexa Health, including physician discretion, Florida and New York-only telehealth services, and requirements for medically appropriate prescribing.

This Prescription Policy ("Policy") explains how prescriptions are evaluated, approved, and issued through telehealth services provided by Herexa Women’s Health, P.A ("Herexa Health," "we," "our," or "us"). This Policy supports safe, lawful, and medically appropriate prescribing practices.

By using our Services, you acknowledge and agree to the terms described in this Prescription Policy.

  • IMPORTANT NOTICE

Prescriptions are issued at the sole discretion of a licensed physician, including Dr. Amir Shay, MD, and only when medically appropriate and permitted by applicable law. Completion of an online assessment or payment of the $59 consultation fee does not guarantee that a prescription will be issued.

1. Physician Medical Judgment

All prescribing decisions are made solely by a Florida and New York licensed physician exercising independent professional medical judgment.

  • Medical information submitted through the platform is reviewed by a licensed physician.
  • Additional questions or follow-up communication may be required.
  • The physician may decline treatment if it is not clinically appropriate.

Herexa Health does not control or influence clinical decision-making.


2. Medical Evaluation Process

Before prescribing medication, the evaluating physician conducts a telehealth assessment which may include review of:

  • Medical history and current symptoms
  • Allergies and prior treatments
  • Current medications
  • Responses to online health questionnaires
  • Relevant clinical risk factors

Some conditions require in-person care, laboratory testing, or additional evaluation before treatment can be considered.


3. Prescription Eligibility

Not all patients are eligible for prescription treatment. Eligibility depends on medical appropriateness, patient safety, and applicable legal requirements.

  • Telehealth may not be suitable for all medical conditions.
  • Certain medications require additional evaluation or in-person examination.
  • The physician may recommend alternative treatment options.

Clinical decisions are individualized and based on each patient’s medical needs.


4. Controlled Substances

Herexa Health complies with all federal, Florida and New York state laws governing controlled substances.

  • Controlled substances may not be prescribed through telehealth where prohibited by law.
  • An in-person medical evaluation may be required.
  • Requests for unsafe or inappropriate medications may result in denial of treatment.

Safeguards are maintained to help prevent misuse or diversion of prescription medications.


5. Prescription Fulfillment

If a prescription is issued:

  • The prescription may be transmitted electronically to a licensed pharmacy.
  • Pharmacies independently review prescriptions before dispensing medication.
  • Medication availability and pricing are determined by the dispensing pharmacy.

Herexa Health does not control pharmacy dispensing decisions.


6. Patient Responsibilities

Patients receiving prescriptions agree to:

  • Provide accurate and complete medical information.
  • Use medications only as prescribed by the physician.
  • Review medication instructions and warnings carefully.
  • Seek medical attention if adverse reactions occur.

Misuse of prescribed medication may result in discontinuation of Services.


7. Compliance with Laws

All prescribing practices comply with applicable healthcare laws, telemedicine regulations, and professional medical standards. Telehealth services are provided only to patients located in Florida or New York where licensed providers are authorized to practice.


8. Changes to This Policy

We may update this Prescription Policy periodically. Updated versions will be posted on this page with a revised effective date.

Continued use of the Services after updates constitutes acceptance of the revised Policy.
